Well its been fun, by when Microsoft threatens to sue, I gotta stop. - 8525, TyTN, MDA Vario II, JasJam ROM Development

I really did not know where to post this, but seeing as 90% of the traffic from the area is from people here in the roms section. As much as I enjoy hosting for people. This is over and done for me. I'm pulling the roms directory off of my server and shutting down the ftp access permanently.
1&1 Internet, Inc. recently received notice under Section 512 of the Digital Millennium Copyright Act (DMCA) alleging that the above website infringes upon copyrighted materials (see attached). We are asking that you remove the content as stated in the attached notice. Should you fail to act upon this notice within 24 hours we will be forced to temporarily suspend your account.
Under the DMCA, you are entitled to provide "counter-notice" to 1&1's DMCA agent claiming that the material does not infringe copyrights. If the copyright owner does not bring a lawsuit in district court within 10 days, 1&1 may then reactivate your account. Well Josh, your gonna have to change the links in your sig LOL. I really had to cring as I held my finger of the "delete" key on the entire "Roms" dir. For the record, the link to your folder had been passed around to at least a dozen PPC sites. Your single folder was pulling 3 to 4 times the traffic as even CRC's device update which was mirrored on my server. Trust me you were pretty popular. I hope you find another place to host your most excellent Roms. I'll catch ya on the flip side.

They really want to stop the betas from leaking.

Microsoft seems unfair
YEah it is sad that Microsoft is doing this to us after buying the product and have no support whatsoever after selling the product ( try going to their site and they will give you agents that would probably sell items first before giving their ears for us to tell a problem)
this is sad really ... but it is a good choice to do this step

I understand the concern from MS, but...
Don't want to speak for others, but I've been waiting for something (anything) different from MS on my mobile phones/pdas for over 5 years now and they still offer me that same "today" screen.
This site & the chefs who generously give so much of their time have been able to give me so much more from my phone than MS has, and 6.5 was turning out to be a great follow up.
So now we just wait for MS to actually deliver something.
Not sure I can wait. I'll probably break down and buy an iPhone.

dude... i tried a iphone today... totally tempted to man.... but this is such a cool hobby though.. i don't think i could bring myself to do it.

It turns out that there may be an impersonator lurking around disrupting Windows Mobile communities. In response to an article that was posted this morning about Microsoft demanding that Windows Mobile 6.5 ROM images that were cooked unofficially be taken down, our own Microsoft MVP Adam Z. Lein spotted that the guy responsible for the letter to XDA-Developers may be a fraud, as was posted on PPCGeeks.
A similar hoax had occurred before at msmobiles in regards to Windows Mobile 6.5 screenshots. In the cease and desist letter to msmobiles, the gentleman claiming to be with Microsoft's legal department asked the site to remove screenshots of the forthcoming operating system. The letter was sent after Microsoft had publicly announced and shown the very screenshots at Mobile World Congress 2009. According to msmobiles: "In any case, if it is genuine action on behalf of Microsoft, it is a case of extreme incompetence that this guy is showing because he is requesting removal of pictures of something that has been officially announced few days earlier." It should also be noted that pocketnow.com had posted screenshots and news of Windows Mobile 6.5 before, during, and after Microsoft's Mobile World Congress announcement and we did not receive a cease and desist letter.
The community over at msmobiles performed some additional investigations and found that the gentlemam, James Young, sent emails originating from IP addresses in London and not from Microsoft's corporate headquarters in Redmond, Washington, leading many to believe that he is not connected with the software giant. Additionally, emails were sent from [email protected], and not at a "@microsoft.com" email address.
Whatever the case may be, other forum members in our original post here at pocketnow.com made mention that only the Windows Mobile 6.5 cooked ROM made by ROM chef Da_G was affected and 6.5 ROMs for other HTC-made devices were seemingly okay.

Admins: Just talked with Microsoft being my profession and this was not sitting good with me since it was missing A. a contact phone number and for these cases it must also contain a Digital Signature with that being said they said it is fraud, I gave them the link here and they verified that they do not have a James Young employ and that the email extension [email protected] is not valid furthermore they said on there notices they will also have a phone number for the person(s) to call and correspondence is done through written. I will be receiving an email with the case number and contact information for the antipiracy case manager who verified the information and will forward it to the Admins here and at PPCGeeks as well. If one one the Admins here can PM there email addy so I can send the email to them for future verification on these types of notices.

Un-delete the folder, capt!
Is there a back up of it?

I dumped the entire 4.5gig to a local drive here before I deleted it.
However here is why I am hesitant to put it back up. The email that I got came from 1and1 which hosts my server. 1and1 is taking this fairly seriously. Now it is entirely possible that this guy emailed 1and1 claiming to be from MS and got the warning sent out to me. I know the email from 1and1 was legit as it included my personal account number that is only on file with my account and not part of the registrar or whois info. I'm going to call 1and1 and speak to someone verbally on the phone regarding this. If its all green. I'll start uploading the data.

Capt I understand where you are coming from, the problem is going to be convincing them that this was faked, I suggest getting as much info you can find on this hoax and forwarding it to them, also the mods and admin are looking very closely at this whole thing....so keep an eye out for info from as well

What a load of BS! I've had my Hermes (Cingular 8525) for a while and was about ready to give it up for something new. Then a co-worker with a similiar phone directed me to this site and I new for sure I had to keep it. I had no idea about any of this until recently. I don't even know how many times I had to update my contacts and emails after I found this site There is so much info on this site, all you have to do is look or do a little search.
Now some [email protected]@$$ is trying to ruin it for a whole bunch of people. It's a shame, hope this doesn't affect the XDA world too much. I'm still trying new Rom's to see which one works for me. It's endless!

Not much info in this post, but the link is to the petition to allow XDA-Developers to host ROMs again. MS banned them from hosting them a while back, and all it did was make people use File-Sharing websites instead.
Personally, I think having them held on XDA-Dev and moderated is a much more secure method than having to store them on file sharing.
If you want XDA-Dev to be able to host ROMs, sign the petition. If you don't, don't!

I have absolutely nothing against xda-developers's roms, i've used many of them and I think they're great.
I do, however. think that it's slightly naive to tell a notoriously litigious company that you enjoy stealing their products.
Onto my soapbox
I do not, and never have, considered what XDA Dev does to be stealing. We take released ROMs, and make the best ones we can from the best bits. To my mind, it's very similar to taking a load of Ford cars (say) and making a car with the best bits - so some ROMs have the space of a people carrier (Dutty), some have the performance of a GT (TNT) and some have the customisability of a Focus ST (Pandora). Ford have then come along and told us we cannot hold these finished cars on our yard, so we're making them and distributing them via all the local dealerships!
To my mind, it's much easier to keep dangerous ROMs off the streets (and hence lower "warranty" claims) if we're just allowed to host the ROMs again. That'll give the chefs and mods a lot more control and simplify the current stupid situation of having to use file sharing sites.
Apologies for the analogy (and I know everyone will disagree with the cars/manufacturer/ROMs parrallels, but it was only a hastily thrown together example) but this is just my two cents worth.
unfortunately software is not like a car, it is one of those lovely bits of intangible IP that allows the manufacturer to have enduring rights over it - it doesn't matter what we consider to be stealing, it's not our consideration to make.
tbh i think that xda-devs would be a great help to certain phone companies (just look how awful the first vario II rom was compared to some of the roms that have come out of here), but you may as well petition the RIAA to allow you to download music for free because you're really good at remixing
I do not understand your point. We do not "ask for free music" we already paid for it. As far as i know, our hermes came with a valid licence no? And as far as i know, htc is giving us the ability to download wm6 without paying once more for it...
HTC pay M$ for a license to allow them to create device specific roms, these roms are either distributed to people who bought direct from HTC or are distributed via providers such as tmobile (who license the software from HTC/M$ and develop it further). Similarly, a person who wished to cover or remix a song must obtain the right to do it from the original creator/owner of the intellectual property that is the music/words/etc.
HTC and providers try to protect the money they have paid for licenses by making it necessary to enter IMEI/serial numbers in order to download rom updates and provide them only for their customers.
Xda developers do not license the right to develop roms from M$ or HTC
Umm, You all do know that you're quite a few months late on this whole spreading the word on the petition thing...right?
I did sign the petition...long ago, but myself..I don't see what the fuss is about, Im sure I have missed a couple posts, but so far in this wm6 section, I have only seen one person with a bogus ROM they had got, and were asking about, also Im pretty sure they said that came from a torrent.
The ftp here isn't known to be the cleanest, as far as bogus files etc, and yes I know there is a locked down section..once the file is approved or whatever the word used in this case might be, but that requires mod's to constantly stay ontop of, and files are shared before they get there.
Also, I don't know how fat the pipe is here, but all this hosting on the fileshare sites has to be helping..I would think, cause the number of HTC devices increases, along with the numbers of cooked ROM's, Im sure even now, the number of downloads for all the cooked roms just in this section has to be outrageous.

As it has been posted OFFICIALLY by mods here, there is no current issue posting or sharing the Palm Pre images and such. There has been no official word from Palm - currently there is a sketchy email and that is all.
If l3wish isn't putting his theme back up, it's for one of three reasons. 1. he's being an idiot. 2. he's not listening to anybody but himself (sounds like alot of people). 3. he knows something we don't. Just from a statistical metric, I'd bet on 1 or 2.

I would do it in a heart beat(but I wont cuz I love my theme )... I hate to sound like a broken record to you guys but READ THE FAIR USE ACT! Your theme does not "copy the palm interface", it graphically adapts the g1 interface as a parody of the palm pre. You have not infringed on anybody's copyright, regardless of what they say. If your interface was a wholesale copy, or made profit, or was created as something other than a personal research project, it might be a problem. But it wasn't, and so they don't have a damn leg to stand on
I say again to the theme creators of xda: You CANNOT be sued for being visually similar to another OS. You must use COPYRIGHTED material in EXACT duplicate. And unless the little up arrow thingy is a palm copyrighted mark, they don't have have ANYTHING.
Jesus, I don't have a problem with people saying they "just don't want the hassle", but admitting to having committed a wrong when it is clear that you have not is just STUPID!
I'm sorry if I sound angry, I'm more pissed at palm than at the devs, but if you take a moment to read the relevant legal code, you'll realize you are safe and in the clear.

That submission system is horrible, in every way possible.
I think that the one who developed it was TRYING to make is as bad, irritating and un user-friendly as possible.
Why the **** would you block the browsers back function AND open in new tab function. Also, the UI makes no sense at all. It took me several minutes to realize that there actually was a way to step back to the enteries list.
And. The idea at first place is horrible. Who the **** would use that?

I think the main point of this Microsoft initiative is to allow regular users (not power enthusiasts) to get their ideas out and there and iterate in a community fashion. Already, I've been threads pop up on the site, with people contributing new features and fleshing out applications. Sure, the idea gets out there and is essentially public domain, but if the user truly believes in the idea, perhaps someone else, not necessarily Microsoft will pick it up.
Appubator sounds like a pretty neat business model, but the apps that do get submitted seem to go into a deep, dark hole. There's no visibility into how the final application will develop from the initial kickoff idea. And to play devil's advocate, there's little to stop you from 'rejecting' an idea, only to come up with another application that is but a variation on a theme. I am in no way saying that you have, or will do this.
Both models are valid, I'd just like to throw a somewhat counter-argument out there for people to consider as well. No offence intended at all, Appubator!

Thanks for replying to my posts! No offense taken at all.
You bring up few interesting points and since this is out in the public, I'd like to clarify a few things:
appubator isn't intended for power users. Its more for the 'average joe' who uses smartphones and might have a great idea but no understanding or resources to make it happen. By submitting an idea and our current high rate of approvals, they have a real chance of their app making its way to market.
As for your 'black hole' comment, we've worked hard to build a system that's based on secure submission of the idea and to provide timely feedback to the user. When submitted, we score the idea (which the user can see) and look to provide approval / rejection for most ideas within 30 days.
Your point about rejecting then doing variations is the farthest from our minds. We don't believe our business will work f we did not treat submitters fairly and regard their submissions with the highest levels of integrity. There's actually been a case where we independently had an idea prior to a submission, but to ensure that there were not concerns, we recognized the submitter's idea anyway and executed our rev. share agreement.
Basically, we at appubator think that throwing all these ideas out into the public domain is wasteful. There would likely be a dozen or more commercially viable concepts within and folks have better odds of making their $5,000 by working with appubator or other app development houses than this contest.

Weather Alarm is an app that checks your current location via my location service and then checks accuweather or other weather service for upcoming weather changes.
Just before the regular alarm clock ring time, the weather alarm checks the weather. If the forecast is significantly different from what it was the last couple of days, the screen flashes at the time of the alarm notifying the user of clothing/accessories he/she must carry for this day (ie. take the umbrella, take a hat and sunglasses, take water with you, take your coat, use non slippy shoes, wear sun lotion etc.)

I'm supporting everyone who posts here. I truely hope someone from XDA wins. Microsoft owes its existence to this site, we've been fixing WM since forever, give us some love. I've been seeing a lot more interest lately from the XDA community regarding Azure and figure it is worth starting a thread to try to answer some basic questions.
First, I'll be up front with everyone...BizSpark is my day job, I work for Microsoft and technology evangelism is my passion. I can think of few things more exciting than what the Cloud is going to bring to the market through mobile device in the next few years. We know who's going to be on the front lines of driving this innovation: you are. So let's answer those questions:
How does someone get Azure for free through BizSpark?
Sign up for a BizSpark account here​This is the updated site that offers information: BizSpark Azure.
Deal is, you sign up for the introductory offer (free), set your subscription to (not “Auto Renew”), and then after 16 months sign up for the BizSpark Azure (Again, free) for the end of your agreement. ​
Who qualifies?
Yes, there are qualifications, but pretty much anyone who cares enough about software development to be reading this sub-forumon XDA will qualify. If you are actively developing software, you aren't developing this project for a publicly traded company, your project/startup is less than three years old and is making less than US $1M annually, you qualify. That simple.​
What other products can I get?
BizSpark pretty much gives you a premier MSDN account for three years, so if it is on MSDN, you can use it. Dfinitly everything you car about: Visual Studio, all of the Expressions products, etc.
Many products have stipulations that they be used for development purposes only, but Azure, Server, SQL, etc can be used in production, meaning you can go live, host your product and try to make some money with it. ​
Can I get a free AppHub developer account, too?
No, but there's always hope...

Because there should be no excuses for startup developers to not have access to the best software development tools on the planet. ​

I applied, but...my company is older than three years, but has only done software dev for one year. Hopefully I'll be allowed in, but not holding my breath. Might actually still be cheaper to create a new company and apply via that

For those weary about bizspark, it is a great thing for start ups. There are other things that come with it... not just free software. I am glad someone from MSFT is here to talk about it. You do need to be less than 3 years old and make less than a million dollars in revenue in a year -- which is always the case for most startups.

Dropbox has banned the new BitTorrent startup Boxopus from accessing its API. The company fears that BitTorrent’s piracy stigma may rub off on the successful cloud storage service. The Boxopus team is disappointed by this anti-innovation move. Thousands of dollars in developments costs have gone down the drain for what they believe is an irrational fear imposed by a growing copyright lobby.
On Saturday we covered Boxopus, a new startup that allows people to download torrents directly to their dropbox folders.
The news was quickly picked up by many other technology sites and as a result the service’s member count surged to more than 50,000. Boxopus didn’t go unnoticed by the people at Dropbox either.
However, where most reviews heralded the usefulness of the service, Dropbox sees it as a threat.
Although Boxopus is a neutral technology, BitTorrent’s piracy stigma is something Dropbox wants to stay far away from. Apparently, the company believes that a ‘perceived’ link to piracy is enough to ban Boxopus from accessing its API.
A few hours ago the Boxopus team received the following email from one of Dropbox’s engineers (emphasis added):
“It’s come to our attention that latest Boxopus features could be perceived as encouraging users to violate copyright using Dropbox.”
“Violating copyright is against our terms of service, so we are terminating your app’s API access. Once your access is revoked, any API calls your app makes will fail.”
Shortly after this email the API access was pulled, effectively killing the Boxopus service.
To the developers the news came as a shock. Not only was Boxopus adhering to all DMCA requirements, Dropbox also explicitly approved an alpha version of Boxopus weeks earlier.
At the time no alarm bells went off, so the developers continued investing in the product.
“Once the alpha version was approved we were pretty sure that Dropbox was okay with it, so we put our efforts into optimizing the service. It took us 3 months to finish the product with a team of 5 people, which was a $30,000 USD investment,” Boxopus founder Alex tells TorrentFreak.
But now, just a few days after the service had its breakthrough online, the service is dead. Aside from the massive financial loss, the Boxopus team is also disappointed by the way innovation has been stifled by Dropbox due to a perceived threat that may not even be justified.
“This behavior makes it hard to believe that developers are treated fairly and innovation is welcomed at Dropbox. It seems like legit and pre-approved applications may be blocked simply by someone’s will although they act within the scope of company’s terms and international laws,” Alex says.
The Boxopus developers are not blind to the fact that people use BitTorrent to share copyrighted files, but that was in no way what their service was designed for.
“Many people see BitTorrent as a synonym of piracy, however, a lot of interesting legal stuff can be found in BitTorrent networks and this is what Boxopus is made for.”
Nevertheless, Dropbox has made up its mind and a BitTorrent download service is not allowed. To save what’s left the Boxopus team is now negotiating with other cloud storage services to continue their business with a more tolerant partner.
